Welcome to WeVibe.

These Terms & Conditions (“Terms”) govern your use of the WeVibe mobile application, website, and related services (collectively, the “Service”), operated by WeVibe Inc. (“WeVibe”, “we”, “our”, or “us”).

By downloading, accessing or using WeVibe, you agree to be bound by these Terms.

If you do not agree, please do not use the Service.

1. Eligibility

You must be at least the minimum legal age in your jurisdiction, to use WeVibe.

By using the Service, you represent that you meet these requirements.

2. Description of the Service

WeVibe is an AI-powered conversation intelligence platform that analyzes recorded conversations to generate insights regarding communication styles, behavioral tendencies, emotional tone and group dynamics.

The Service is intended solely for:

• personal development
• communication improvement
• coaching
• leadership development
• education
• relationship improvement

The Service is not intended to provide medical, psychological, psychiatric or legal advice.

3. User Responsibility

You agree to use WeVibe responsibly.

You are solely responsible for:

• recordings you upload
• content you create
• your use of AI-generated insights
• complying with all applicable laws

4. Recording Consent

You are solely responsible for obtaining all legally required permissions and consents before recording any conversation.

By uploading a recording, you represent and warrant that:

• all participants have provided any consent required under applicable law
• your recording does not violate any privacy or wiretapping laws
• you have the legal right to upload the recording

WeVibe may suspend or terminate accounts used in violation of these requirements.

5. AI-Generated Results

WeVibe uses Artificial Intelligence and statistical models to generate insights.

The results:

• are probabilistic
• may contain inaccuracies
• should be interpreted as guidance only

AI-generated insights must never be considered factual statements regarding an individual.

6. Prohibited Uses

You agree not to use WeVibe:

• for surveillance
• to secretly record individuals
• for harassment
• for discrimination
• for employment decisions
• for insurance decisions
• for legal decisions
• for immigration decisions
• for medical diagnosis
• for psychological diagnosis
• for credit scoring
• for any unlawful purpose

7. No Professional Advice

WeVibe does not provide:

• medical advice
• psychological advice
• psychiatric advice
• legal advice
• financial advice
• employment advice

Nothing generated by WeVibe should replace qualified professional judgment.

8. User Content

You retain ownership of the recordings and content you submit.

You grant WeVibe a limited license to process your content solely for providing the Service.

We do not claim ownership of your recordings.

9. Privacy

Your use of WeVibe is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, process, store and protect personal information.

10. Subscription Services

Certain features require a paid subscription.

Subscriptions automatically renew unless canceled before the renewal date.

Subscription pricing is displayed within the application.

Apple and Google manage billing according to their respective subscription policies.

Refunds are subject to Apple App Store or Google Play policies.

11. Intellectual Property

The WeVibe application, software, AI systems, trademarks, logos, graphics, documentation and content are protected by intellectual property laws.

Except as expressly permitted, no part of the Service may be copied, modified, reverse engineered or redistributed.

12. Acceptable Use

You agree not to:

• attempt unauthorized access
• interfere with system security
• upload malicious software
• exploit vulnerabilities
• overload our servers
• automate access without authorization
• use the Service for illegal activities

13. Data Retention

Users may delete recordings and analyses at any time.

Certain information may be retained where required by law or necessary for security, fraud prevention or dispute resolution.

14. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE.”

To the fullest extent permitted by law, WeVibe disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not guarantee uninterrupted availability, error-free operation or the accuracy of AI-generated insights.

15. Limitation of Liability

To the maximum extent permitted by applicable law, WeVibe shall not be liable for any indirect, incidental, consequential, special, punitive or exemplary damages arising from your use of the Service.

Our total liability shall not exceed the amount you paid to WeVibe during the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless WeVibe and its officers, employees and affiliates against claims arising from:

• your use of the Service
• your recordings
• your violation of these Terms
• violations of applicable law

17. Account Suspension

We may suspend or terminate accounts that:

• violate these Terms
• misuse the Service
• threaten platform security
• violate applicable laws

18. Changes to the Service

We may modify, update or discontinue any part of the Service at any time.

We may also update these Terms.

Material changes will be communicated through the application or website.

19. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which WeVibe Inc. is incorporated, without regard to conflict of law principles.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction, unless otherwise required by applicable consumer protection laws.

20. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and WeVibe regarding your use of the Service.
